CTG recruit and manage qualified, skilled teams with extensive experience operating in challenging conditions.Overview of positionThe long and protracted civil war in Somalia, inter alia, destroyed public service infrastructures and robbed the country of most of its professional human resources. One of the key outcomes of these developments is the lack of sufficient levels of qualified manpower within government establishments. Staff capacity across the government is low, and the few professionals that are currently in government institutions are underemployed. In Puntland, these challenges are compounded by the absence of any visible mechanisms for employee performance management.
In addition to the foregoing state of affairs is the lack of clarity in mandates and functions across government institutions and between the Federal and the State Governments. In Puntland, clear policy frameworks, strategies, systems and procedures in most government institutions are largely absent, often leading to competing and overlapping functions. In particular, the civil service legal and regulatory frameworks, which provide the overall guidance for civil service management are incomplete and insufficiently adhered to.
This project is designed to respond to some of these challenges. It seeks to support the capacity development of the Federal Government of Somalia, the Somaliland Government and the Puntland State Government. For Puntland, the project particularly aims at strengthening the performance of key government institutions, including the Ministry of Planning and International Cooperation through the implementation of five key engendered and conflict sensitive performance enhancement support initiatives in support of civil service management and core of government functions in Puntland:
  • Civil Service Management.
  • Civil Service Training.
  • Good Governance.
  • Gender Mainstreaming.
  • Aid and Development Coordination.
In line with the foregoing objectives of the SIP project, the State Government of Puntland requests UNDP to support the Ministry of Labor Youth and Sports (MOLYS) in finalizing the drafting the Civil Service Law #5 and the supporting regulations. In support of this process on March 7, 2016, MOLYS appointed a consulting committee to carry out the above mentioned responsibilities. The draft legislation has been reviewed and is now ready for presentation to the Cabinet. However before this exercise is done, public consultations have to be held to endorse he document. Legal experts will have to work on this task and ensure that expert advice is driven to the Minister and his staff.
Role objectives-
  • Conduct consultative workshops on civil service law reform.
  • Validation of the contents and substance of the Drafted Civil Service Law #5.
  • Validation of the contents and substance of the Drafted Regulations.
  • Ensuring that English version and Somali versions will meet the needs of the Puntland Civil Service Reform.
Expected output:
  • This work will be carried out under the UNDP DIM modality as MOLYS does not have an LOA with UNDP. It is expected that by the end of this contract Civil Service Law #5 will have been updated and verified to a stage where it is suitable to present it to the Cabinet and for Presidential assent.
  • The consultancy will be jointly monitored by both the counterpart (target) institutions and UNDP. MOLYS and the UNDP SIP Team will ensure the consultant undertakes her/his work in line with the terms of reference of the consultancy.
The consultant will generate the following deliverable's:
  • Reviewing proposed civil service law and its regulations through consultative workshops and regular meeting with the consultants.
  • Commenting the civil service law and its regulations and giving feedback's on the relevant articles and
  • provisions.
  • Contextualizing of the bill and its regulations by incorporating the necessary articles and provisions into the bill.
  • Validating the contents and substance of the Drafted Civil service law and regulations through validation meeting and workshops with the consultant and the staff of the ministry.
  • Ensuring that English version and Somali versions will meet the needs of the Puntland Civil Service Reform.
  • Working closely with the Legal experts in the process of review of Puntland Civil Service Law.
Project reporting:
  • This role report to the SIP, Puntland Team Leader.Key competencies
Education:
  • Advanced degree in law, public administration, political science, governance or related fields or a first degree in the same fields with additional two years’ experience.
Experience:
  • The consultant will need to demonstrate skills and competencies in the following areas:
  • 10 years’ professional experience in legal reform exercise, public service, legal service, anti-corruption and related fields.
  • Experience working in a developing and post conflict country context.
  • Demonstrated ability to effectively communicate orally and in writing.
Language Requirement:
  • English.
  • Expert knowledge of Somali will be an added advantage.
Team management:
  • This role does not have team management responsibility.
